This Privacy Policy explains how Kreatif, operating under the KOLORS brand (“KOLORS,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information when you visit, interact with, or purchase from www.kolorsbrand.us (the “Site”).

This Policy applies to customers and Site visitors in the United States and Canada. Depending on where you live, additional privacy rights may apply.

2. Personal information we collect

Depending on how you use the Site, we may collect:

Contact information: name, email address, telephone number, billing address, and shipping address.
Order information: purchased products, selected options, order value, currency, discounts, transaction history, delivery details, returns, claims, and customer-support communications.
Payment information: payment status, payment method, and limited transaction details. Complete card information is processed by Shopify and the selected payment provider and is not received by KOLORS.
Customization content: photographs, names, dates, messages, design instructions, and other content voluntarily submitted for a custom artwork.
Account information: login credentials and account settings, if customer accounts are enabled.
Device and usage information: IP address, browser, device, operating system, referring pages, pages viewed, interactions, approximate location, cookie identifiers, and similar technical information.
Marketing information: subscription status, communication preferences, and interactions with marketing emails or advertisements.
Fraud and security information: information reasonably used to verify transactions, protect accounts, and detect suspicious activity.

3. How information is collected

We collect personal information:

directly from you when you place an order, contact us, or submit content;
automatically through cookies and similar technologies;
from Shopify, payment providers, carriers, and production partners;
from advertising, analytics, and social-media partners where permitted; and
from fraud-prevention and security providers.

4. How we use personal information

We may use personal information to:

process payments and fulfill, produce, ship, and track orders;
create personalized artwork according to customer instructions;
send order, production, shipping, and service communications;
provide customer support and handle claims or refunds;
operate, secure, troubleshoot, and improve the Site;

measure Site performance and understand customer interactions;
personalize content and advertising where permitted;

Shopify, which provides the e-commerce platform;
payment processors and fraud-prevention providers;
production, printing, framing, and fulfillment partners;
shipping carriers, customs agents, and delivery providers;

analytics, advertising, email, and social-media providers;
accountants, insurers, legal advisers, and other professional advisers;
authorities or other parties when disclosure is required by law; and

Service providers are permitted to process information only for the relevant services and subject to their contractual and legal obligations.

7. Marketing communications

We send promotional emails or text messages only when permitted by applicable law. Canadian commercial electronic messages are sent with valid express or implied consent or another authorization recognized by Canada’s Anti-Spam Legislation (CASL).

You may unsubscribe at any time using the link in an email or the instructions in a message. You will continue to receive necessary transactional messages, such as order and shipping confirmations.

8. Custom artwork and sensitive content

Please submit only content necessary to create the requested artwork. Do not submit government identification numbers, financial records, health information, or other highly sensitive information. Customer-submitted photographs and design materials are used to review, create, fulfill, and support the order.

9. International processing

KOLORS is established in France and serves customers in the United States and Canada. Shopify and other service providers may process information in France, Canada, the United States, or other countries. Information processed in another jurisdiction may be accessible to courts, law enforcement, or authorities under that jurisdiction’s laws.

Where required, we use contractual or other legally recognized safeguards for international transfers.

10. Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including order fulfillment, customer support, warranties, fraud prevention, tax and accounting obligations, dispute resolution, and legal compliance.

Retention periods vary according to the type of information and applicable requirements. Information is deleted or anonymized when it is no longer reasonably required, unless continued retention is permitted or required by law.

11. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. No online transmission or storage system can be guaranteed to be completely secure.

12. Your privacy rights

Depending on where you live and subject to legal exceptions, you may have the right to:

Canadian residents may request information about our privacy practices, access their personal information, request correction, or challenge our compliance by contacting the Privacy Officer. Consent may be withdrawn subject to reasonable notice and legal or contractual restrictions.

14. Québec residents

The person exercising the highest authority within Kreatif is responsible for the protection of personal information unless that responsibility is validly delegated. Privacy questions and requests may be directed to the Privacy Officer, Kreatif at contact@kolorsbrand.us.

Québec residents may have additional rights under Québec privacy law, including rights concerning access, correction, withdrawal of consent, de-indexation in applicable circumstances, data portability when legally available, and information about automated decisions if such decisions are used.

15. United States residents

Residents of certain U.S. states may have additional rights concerning access, correction, deletion, portability, targeted advertising, sale or sharing, and appeals. These rights apply only when the relevant law covers KOLORS and the request. We will respond according to the law applicable to the requester.

16. Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us so we can review and delete it where required.

We do not knowingly sell or share the personal information of individuals under the age at which prior opt-in consent is required by applicable law.

17. Changes to this Policy

We may update this Privacy Policy to reflect changes in law, technology, services, or business practices. The revised version will be posted on the Site with an updated date. Where required, we will provide additional notice or seek consent.
