These Terms of Service govern access to and use of www.kolorsbrand.us (the “Site”). The Site is operated by Kreatif under the KOLORS brand (“KOLORS,” “we,” “us,” or “our”).
By accessing the Site, creating an account, or using its services, you agree to these Terms. Purchases are also governed by our Terms of Sale, Return & Refund Policy, Shipping Policy, Privacy Policy, and any terms displayed on the relevant product page or promotion.
1. Eligibility
You must be legally capable of entering into a binding agreement in your jurisdiction. If you are under the age of majority, you may use the Site only with the involvement and permission of a parent or legal guardian.
2. Permitted use
You may use the Site only for lawful personal or legitimate business purposes. You may not:
- use the Site for fraud or any unlawful activity;
- provide false information or impersonate another person;
- interfere with the Site’s operation, security, or accessibility;
- introduce viruses, malicious code, or automated attacks;
- scrape, harvest, or copy Site content or data at scale;
- attempt to access accounts, systems, or information without authorization;
- circumvent purchase limits, security controls, or promotional conditions; or
- use KOLORS content or intellectual property without permission.
3. Accounts and information
If you create an account, you are responsible for keeping your credentials confidential and for activity conducted through the account. Information supplied to KOLORS must be accurate, complete, and current. Contact contact@kolorsbrand.us promptly if you suspect unauthorized account use.
4. Products and purchases
Product descriptions, prices, available options, production information, and delivery estimates are presented on the Site. We may correct errors, update information, or change products and prices prospectively. Changes do not alter an accepted order except where required to correct an obvious error and with the notice or consent required by applicable law.
The placement of an order does not guarantee acceptance. Order formation, payment, production, shipping, cancellation, claims, and refunds are governed by the Terms of Sale and the applicable customer policies.
5. Intellectual property
The KOLORS name, logos, artwork, designs, illustrations, photographs, videos, text, product descriptions, graphics, and Site layout are owned by or licensed to KOLORS and are protected by applicable intellectual-property laws.
Access to the Site does not grant any ownership or license except the limited, revocable right to view and use the Site for its intended purpose. Purchasing an artwork transfers ownership of the physical product only. It does not transfer copyright or any right to reproduce, modify, distribute, resell copies, create derivative works, or commercially exploit the design.
6. Customer-submitted content
You retain ownership of photographs, text, designs, or other material you submit for customization. You confirm that you own the material or have all permissions necessary for KOLORS to use it.
You authorize KOLORS and its production providers to use submitted material only as reasonably necessary to review, create, fulfill, deliver, and support your order. We may reject content that is unlawful, abusive, infringing, or otherwise inappropriate.
KOLORS will not use customer-submitted content publicly for advertising or promotion without permission or another valid legal basis.
7. Reviews and feedback
Customers may share honest opinions about KOLORS products and services. Nothing in these Terms restricts or penalizes an honest consumer review. Reviews must not contain unlawful content, confidential information, impersonation, spam, or material that infringes another person’s rights.
If you voluntarily submit feedback or a review for publication, you grant KOLORS a non-exclusive, worldwide, royalty-free right to display, reproduce, and format that content for Site and marketing purposes, while you retain ownership of it. This permission does not prevent you from posting the same content elsewhere.
8. Third-party services
The Site may use or link to services operated by Shopify, payment providers, production partners, carriers, analytics providers, social platforms, and other third parties. Their services may be governed by separate terms and privacy policies. KOLORS is not responsible for independent third-party websites or content, except where applicable law provides otherwise.
9. Privacy
Our collection and use of personal information are described in the KOLORS Privacy Policy. By using the Site, you acknowledge that information may be processed by service providers in other states, provinces, or countries as described in that Policy.
10. Site availability
We work to keep the Site secure and available, but we do not guarantee that it will operate without interruption or technical error. Access may be restricted temporarily for maintenance, updates, security, provider outages, or events beyond our reasonable control.
11. Disclaimer and limitation of liability
The Site is provided on an “as available” basis. To the maximum extent permitted by law, KOLORS does not warrant uninterrupted Site availability and is not liable for indirect, incidental, special, or consequential loss arising solely from use of, or inability to use, the Site.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, personal injury caused by negligence, defective-product liability that cannot be limited, or any warranty, statutory guarantee, refund right, or consumer remedy that cannot lawfully be excluded.
12. Suspension and termination
We may restrict or terminate access to the Site when we reasonably believe a user has violated these Terms, threatened Site security, committed fraud, or acted unlawfully. Provisions concerning intellectual property, liability, disputes, and any accrued rights survive termination where appropriate.
13. Governing law and disputes
These Terms are governed by French law because Kreatif is established in France. This choice does not deprive United States or Canadian consumers of mandatory protections available under the law that applies where they live.
Before starting a formal claim, users are encouraged to contact KOLORS so the parties can attempt to resolve the issue. A consumer may bring a claim before any court made available by mandatory applicable law.
Nothing in these Terms requires a Québec consumer to submit a dispute to mandatory arbitration, waive a class action, or bring a claim only outside Québec where such a requirement is prohibited.
14. Changes to these Terms
We may update these Terms to reflect changes in law, Site functions, security, or business operations. The updated version applies from the date displayed at the top of the page. Changes do not retroactively alter an accepted order unless required by law.
15. Severability
If any provision is found invalid or unenforceable, it will be enforced only to the extent legally permitted. The remaining provisions will continue in effect.
